Reservations are not considered confirmed until the corresponding deposit has been paid.<\/p><p><strong>3.2 Deposit payment<\/strong> To confirm the reservation, the Traveler must pay 30% of the total package value. The deadline to make this payment is a maximum of 7 calendar days from the issuance of the formal quotation, unless otherwise specified in writing.<\/p><p><strong>3.3 Balance payment<\/strong> The remaining balance (70%) must be paid according to the following timelines depending on the type of package:<\/p><ul><li>Regular packages without trekking: 45 calendar days before the trip start date<\/li><li>Packages with trekking (Salkantay, Inca Trail, Choquequirao, or others): 60 calendar days before the trip start date<\/li><li>B2B packages and groups: according to conditions established in the specific contract<\/li><\/ul><p>Failure to pay the balance within the indicated deadlines will be considered a voluntary cancellation by the Traveler, with no right to refund of the deposit.<\/p><p><strong>3.4 Accepted payment methods<\/strong><\/p><ul><li>Credit cards: Visa, MasterCard, American Express<\/li><li>International wire transfer<\/li><li>PayPal<\/li><li>Other methods authorized by the Agency<\/li><\/ul><p>Payment processing fees (between 3% and 5% depending on the method) will be communicated to the Traveler before processing the payment.<\/p><p><strong>3.5 Reservation confirmation<\/strong> Once the deposit is received, the Agency will issue an official confirmation within 24 business hours. The confirmation includes package details, dates, assigned hotels, service vouchers, and final trip schedule.<\/p><ol start=\"4\"><li><strong>PRICES AND QUOTATIONS<\/strong><\/li><\/ol><p><strong>4.1 Price validity<\/strong> Prices published on the website and promotional materials are referential and subject to confirmation at the time of reservation. The formal quotation issued to the Traveler has a validity of 7 calendar days, after which it may be revised based on availability and current rates.<\/p><p><strong>4.2 Anniversary pricing<\/strong> Prices identified as &#8220;Anniversary Price 2026&#8221; are valid exclusively for reservations confirmed with deposit paid by December 31, 2026, and for trips beginning within the 2026 calendar year or the following year according to the specific program. As of January 1, 2027, regular pricing will apply.<\/p><p><strong>4.3 Price variations<\/strong> The Agency reserves the right to modify quoted prices in case of:<\/p><ul><li>Significant variations in air, rail, or ground transportation tariffs<\/li><li>Modifications to official rates of Machu Picchu, archaeological sites, or protected natural areas established by Peruvian authorities<\/li><li>Exchange rate variations greater than 8%<\/li><li>Changes in taxes or official fees<\/li><\/ul><p>Any variation will be communicated to the Traveler before final confirmation, who may accept or cancel the reservation with full deposit refund if the adjustment is not accepted.<\/p><p><strong>4.4 Items not included<\/strong> Unless expressly indicated in the formal quotation, the following items are NOT included in the price:<\/p><ul><li>International flights to and from Peru<\/li><li>Domestic flights within Peru (Lima-Cusco-Lima, Lima-Arequipa, Cusco-Puerto Maldonado, others)<\/li><li>Tourist visa when applicable<\/li><li>Travel insurance (highly recommended)<\/li><li>Meals not specified in the itinerary<\/li><li>Beverages during included meals<\/li><li>Tips for guides, drivers, porters, and hotel staff<\/li><li>Personal expenses and non-contractual items<\/li><li>Optional excursions and services<\/li><\/ul><ol start=\"5\"><li><strong>CANCELLATION POLICY<\/strong><\/li><\/ol><p><strong>5.1 Cancellation by the Traveler \u2014 regular packages without trekking<\/strong><\/p><ul><li>More than 60 calendar days before the trip start: 100% refund, minus a USD 200 administrative fee per traveler<\/li><li>Between 30 and 60 calendar days: 50% refund of total amount paid<\/li><li>Less than 30 calendar days: no refund<\/li><\/ul><p><strong>5.2 Cancellation by the Traveler \u2014 packages with trekking<\/strong><\/p><p>Due to the special conditions of trekking products (limited permits, advance booking of porters, lodges, equipment, and specialized guides), the following stricter conditions apply:<\/p><ul><li>More than 90 calendar days before the trip start: 100% refund, minus a USD 250 administrative fee per traveler<\/li><li>Between 60 and 90 calendar days: 70% refund<\/li><li>Between 30 and 60 calendar days: 50% refund<\/li><li>Less than 30 calendar days: no refund<\/li><\/ul><p><strong>5.3 Cancellation of non-refundable services<\/strong><\/p><p>Regardless of the previous timelines, the following services are non-refundable once issued, as the corresponding authorities or providers do not allow returns:<\/p><ul><li>Machu Picchu tickets (managed by the Ministry of Culture of Peru)<\/li><li>Inca Trail permits (managed by SERNANP)<\/li><li>Train tickets to Aguas Calientes (PeruRail \/ Inca Rail)<\/li><li>Domestic flights already issued<\/li><li>Hotels with non-refundable policies of their own<\/li><li>Specialized operators such as Salkantay Sky Lodges, Mountain Lodges of Peru, Inkaterra, and others with independent policies<\/li><\/ul><p>These amounts will be deducted from the refund according to each provider&#8217;s specific policy.<\/p><p><strong>5.4 Cancellation by the Agency<\/strong><\/p><p>The Agency reserves the right to cancel the trip in exceptional cases such as:<\/p><ul><li>Insufficient travelers in group programs (notified at least 30 days in advance)<\/li><li>Force majeure events (see section 9)<\/li><li>Non-payment by the Traveler<\/li><\/ul><p>In case of cancellation by the Agency that is not due to force majeure or Traveler default, 100% of amounts paid will be refunded, with no right to additional compensation.<\/p><p><strong>5.5 Refund processing<\/strong><\/p><p>Approved refunds are processed within 30 calendar days following confirmation of cancellation, through the same payment method used for the reservation. Banking or payment platform costs derived from the refund are the responsibility of the Traveler.<\/p><ol start=\"6\"><li><strong>RESPONSIBILITIES AND OBLIGATIONS<\/strong><\/li><\/ol><p><strong>6.1 Agency obligations<\/strong><\/p><p>Advice Peru commits to:<\/p><ul><li>Provide all contracted services according to the confirmed itinerary<\/li><li>Maintain certified professional guides<\/li><li>Verify the quality of associated providers (hotels, transportation, lodges)<\/li><li>Provide 24\/7 assistance during the trip<\/li><li>Communicate in a timely manner any necessary itinerary modification<\/li><li>Comply with current Peruvian tourism operation regulations<\/li><\/ul><p><strong>6.2 Traveler obligations<\/strong><\/p><p>The Traveler commits to:<\/p><ul><li>Provide truthful and complete personal and contact information<\/li><li>Present valid documentation (passport with minimum 6 months validity from the return date, visa when applicable)<\/li><li>Arrive punctually to contracted services<\/li><li>Respect schedules and rules established by the Agency and providers<\/li><li>Maintain valid travel insurance covering medical evacuation, especially in programs with trekking<\/li><li>Declare before booking any medical condition that could limit participation in program activities<\/li><li>Respect Peru&#8217;s cultural and natural heritage, as well as the customs of visited communities<\/li><\/ul><p><strong>6.3 Limitation of Agency liability<\/strong><\/p><p>The Agency acts as an intermediary between the Traveler and service providers (hotels, airlines, railways, restaurants, lodges, excursion operators). Therefore, the Agency is not responsible for:<\/p><ul><li>Delays, cancellations, or modifications of services by third-party providers<\/li><li>Loss or damage of luggage not attributable to the Agency<\/li><li>Accidents arising from free Traveler activities outside the contracted program<\/li><li>Itinerary changes due to climatic, social, or political conditions<\/li><li>Injuries arising from physical activity inherent to trekking or other adventure activities when the Traveler has not declared relevant medical conditions<\/li><\/ul><ol start=\"7\"><li><strong>\u092f\u093e\u0924\u094d\u0930\u093e \u092c\u0940\u092e\u093e<\/strong><\/li><\/ol><p>The contracting of an international travel insurance with minimum coverage of USD 100,000 including medical expenses, medical evacuation, repatriation, and trip cancellation is <strong>highly recommended for all packages<\/strong> and <strong>mandatory for programs that include trekking, climbing, rafting, sandboarding, or other adventure activities<\/strong>.<\/p><p>The Traveler must present a copy of the valid policy at least 30 days before the trip start. The Agency may offer insurance quotations from Peruvian or international companies upon request.<\/p><p>Failure to present insurance for programs that require it may result in inability to perform certain activities, with no right to refund.<\/p><ol start=\"8\"><li><strong>MEDICAL CONDITIONS AND ALTITUDE NOTICE<\/strong><\/li><\/ol><p><strong>8.1 Altitude notice<\/strong><\/p><p>Most packages offered by the Agency include visits to high altitude regions (Cusco 3,400m \/ 11,150ft; Puno 3,800m \/ 12,470ft; Colca 3,600m \/ 11,810ft; Palccoyo 4,900m \/ 16,075ft; Salkantay Pass 4,650m \/ 15,255ft; Vinicunca 5,200m \/ 17,060ft). Altitude sickness (soroche) can affect people in apparently normal health conditions.<\/p><p>We especially recommend consulting with your physician before traveling in case of:<\/p><ul><li>Cardiovascular diseases<\/li><li>Pulmonary diseases (asthma, COPD)<\/li><li>Uncontrolled hypertension<\/li><li>Diabetes<\/li><li>Pregnancy<\/li><li>Age over 70 with pre-existing conditions<\/li><\/ul><p><strong>8.2 Mandatory medical declaration<\/strong><\/p><p>The Traveler is required to declare in writing, before reservation confirmation, any pre-existing medical condition, severe allergies, regular medication, or physical limitation that could affect participation in program activities. Omission of this information releases the Agency from any liability.<\/p><p><strong>8.3 Medical care during the trip<\/strong><\/p><p>In case of medical emergency during the trip, the Agency will coordinate access to the nearest medical facilities. Medical costs are the exclusive responsibility of the Traveler or their travel insurance.<\/p><ol start=\"9\"><li><strong>FORCE MAJEURE<\/strong><\/li><\/ol><p>Force majeure is understood as any event beyond the control of the parties that prevents total or partial fulfillment of the contract, including but not limited to:<\/p><ul><li>Natural disasters (earthquakes, floods, landslides)<\/li><li>Pandemics or health emergencies declared by authorities<\/li><li>Social conflicts, strikes, or road blockades<\/li><li>Temporary closure of airports, archaeological sites, or natural areas by government decision<\/li><li>Armed conflicts or terrorism<\/li><li>Government decisions of Peru or the Traveler&#8217;s country of origin that prevent the trip<\/li><\/ul><p>In cases of force majeure, the Agency will work in good faith to reschedule services or issue a travel voucher valid for 12 months. The Agency shall not be obligated to compensate the Traveler for indirect damages arising from force majeure.<\/p><ol start=\"10\"><li><strong>PERSONAL DATA PROTECTION<\/strong><\/li><\/ol><p><strong>10.1 Data processing<\/strong><\/p><p>The Agency collects, processes, and stores the Traveler&#8217;s personal data exclusively for:<\/p><ul><li>Reservation management and provision of contracted services<\/li><li>Issuance of tickets, confirmations, and travel documentation<\/li><li>Operational communication before, during, and after the trip<\/li><li>Compliance with legal tax and migratory obligations<\/li><li>Sending commercial communications only with express consent<\/li><\/ul><p><strong>10.2 Regulatory compliance<\/strong><\/p><p>The Agency complies with:<\/p><ul><li>Peruvian Personal Data Protection Law N\u00b0 29733<\/li><li>General Data Protection Regulation (GDPR) of the European Union, for data of Travelers residing in EU member countries<\/li><li>California Consumer Privacy Act (CCPA) and other applicable US state regulations, for data of Travelers residing in the United States<\/li><li>Other local regulations applicable according to the Traveler&#8217;s nationality<\/li><\/ul><p><strong>10.3 Traveler rights<\/strong><\/p><p>The Traveler has the right to:<\/p><ul><li>Access their stored personal data<\/li><li>Request correction of inaccurate data<\/li><li>Request deletion of their data when no longer necessary<\/li><li>Request portability of their data to another controller<\/li><li>Object to commercial-purpose processing<\/li><li>Withdraw consent at any time<\/li><\/ul><p>To exercise these rights, the Traveler may write to <a href=\"mailto:info@adviceperu.com\">info@adviceperu.com<\/a>.<\/p><p><strong>10.4 Data sharing<\/strong><\/p><p>The Traveler&#8217;s data may be shared exclusively with providers directly involved in the provision of contracted services (hotels, airlines, lodges, excursion operators, insurance companies). Data will not be sold or transferred to third parties for advertising purposes without express consent.<\/p><ol start=\"11\"><li><strong>CLAIMS AND DISPUTE RESOLUTION<\/strong><\/li><\/ol><p><strong>11.1 Claims during the trip<\/strong><\/p><p>Any dissatisfaction must be communicated immediately to the guide or coordinator in charge, as well as to the 24\/7 operations team of the Agency (phone and email provided at the time of confirmation), to manage a timely solution.<\/p><p><strong>11.2 Claims after the trip<\/strong><\/p><p>Formal claims after the trip must be submitted in writing to the Agency within 30 calendar days following the trip&#8217;s completion. The Agency will issue a formal response within 30 calendar days following receipt of the claim.<\/p><p><strong>11.3 Alternative resolution<\/strong><\/p><p>If no agreement is reached, the parties agree to first resort to mediation through an accredited mediator in Peru. If mediation does not reach an agreement, the dispute will be resolved through arbitration administered by the Arbitration Center of the Lima Chamber of Commerce, in accordance with its current regulations. The arbitration award will be final and binding.<\/p><p><strong>11.4 Jurisdiction and applicable law<\/strong><\/p><p>These Terms and Conditions are governed by the laws of the Republic of Peru. Without prejudice to the arbitration clause in section 11.3, any residual judicial action will be submitted to the jurisdiction of the courts of the city of Cusco, Peru.<\/p><p><strong>11.5 Peruvian Consumer Protection Book of Claims<\/strong><\/p><p>In accordance with Peruvian legislation, the Agency makes its Book of Claims available to the Traveler, accessible at its physical office in Cusco and in virtual format on its website.<\/p><ol start=\"12\"><li><strong>\u00a0INTELLECTUAL PROPERTY<\/strong><\/li><\/ol><p>All content on the website, promotional materials, photographs, videos, drafted itineraries, and sales scripts of the Agency is intellectual property of Advice Peru Travel Agency E.I.R.L. and is protected by Peruvian and international copyright laws. Any total or partial reproduction requires prior written authorization.<\/p><ol start=\"13\"><li><strong>MODIFICATIONS TO TERMS<\/strong><\/li><\/ol><p>The Agency reserves the right to modify these Terms and Conditions at any time. Modifications will take effect from their publication on the official Agency website. Confirmed reservations will be subject to the terms in effect at the time of confirmation, unless the change is required by legal regulation.<\/p><ol start=\"14\"><li><strong>\u00a0FINAL PROVISIONS<\/strong><\/li><\/ol><p><strong>14.1 Severability<\/strong> If any clause of these Terms is invalid or unenforceable under current legislation, the remaining clauses shall maintain full validity and effect.<\/p><p><strong>14.2 Languages<\/strong> These Terms are available in Spanish, English, and German. In case of discrepancy between versions, the Spanish version shall prevail as it corresponds to the applicable legal jurisdiction.
